District judge rules in favor of Lucas County Commissioners over EPA
On November 13, James Carr, U.S. District Judge for the Northern District of Ohio, denied the U.S. Environmental Protection Agency’s motion to dismiss the lawsuit filed by the board of Lucas County Commissioners.
The commissioners’ lawsuit, which was filed April 18 in U.S. District Court in Toledo, asks the court to force the EPA to comply with its legal obligations under the Clean Water Act regarding the impaired status of Lake Erie.
“This is not a final victory in this very crucial case. The final victory for the residents of northwest Ohio will come when an effective remedial plan is adopted by federal and state EPA officials that addresses the continuing harmful algal problems of Lake Erie. But this is a very important step to that victory,” the county commissioners said.
